Overview
Welcome to Bursta OTS. "We," "us," and "our" refer to Amadeo Hughes Design dba Bursta OTS. We operate this store and website, including all related content, features, products, and services (the "Services"), powered by Shopify.
These Terms of Service ("Terms") describe your rights and responsibilities when you use the Services and include important provisions covering warranty disclaimers and limitations of liability. By visiting, interacting with, or purchasing from the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.
1. Eligibility and Account
By using the Services, you represent that you are at least the age of majority in your state of residence. You are responsible for the accuracy of any information you provide and for maintaining the security of your account, if you create one. You may not transfer, sell, or assign your account to anyone else.
2. Products
We've made every effort to represent our products accurately. However, colors, prints, fabric texture, and overall appearance may vary from how they appear on your screen, depending on your device, your display settings, lighting conditions, and the production process. Some imagery on our store may be rendered, illustrated, or otherwise composed digitally before physical samples are photographed. We do not warrant that any product will exactly match its on-screen depiction.
We may change product descriptions, limit quantities, or discontinue products at any time without notice.
3. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance and your payment is processed. Once an order is accepted, we may not be able to accommodate cancellation requests.
Your purchases are subject to our Return & Refund Policy and are for personal or household use only, not for commercial resale.
4. Pricing and Payment
Prices, discounts, and promotions are subject to change without notice. The price you'll be charged is the price in effect when your order is placed, as set out in your order confirmation email. Unless stated otherwise, posted prices don't include applicable taxes, shipping, or handling.
You represent that the payment information you provide is accurate, that you're authorized to use the payment method, and that the charges will be honored. You agree to pay all charges incurred, including any applicable taxes.
5. Shipping and Delivery
All delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or other events outside our control. Risk of loss passes to you once we transfer the product to the carrier. See our Shipping Policy for full details.
6. Intellectual Property
The Services and all content within them - including the Bursta OTS name, logo, designs, artwork, graphics, photography, video, copy, and arrangement - are owned by Amadeo Hughes Design or its licensors and are protected by U.S. copyright, trademark, and other intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publish, or commercially exploit any of our content without our prior written consent. All rights not expressly granted here are reserved.
7. Third-Party Links
The Services may link to third-party websites or contain embedded third-party functionality. We don't control or endorse those sites and aren't responsible for their content, products, or practices. Reviewing third-party terms before using them is on you.
8. Relationship with Shopify
Bursta OTS is powered by Shopify, which provides the technology platform behind the Services. Any purchases you make are directly with Bursta OTS, not Shopify. You acknowledge that Shopify is not responsible for any aspect of your transactions with us, and you release Shopify and its affiliates from any related claims, damages, or liabilities.
9. Privacy and Marketing Technologies
All personal information collected through the Services is governed by our Privacy Policy, which covers our use of cookies, analytics, and advertising and conversion-tracking technologies (including the Meta Pixel and Conversions API), and how we use your information. By using the Services, you acknowledge you've read our Privacy Policy.
10. Feedback and Reviews
If you submit reviews, suggestions, photographs, or any other content to us ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute that Feedback in any medium for any purpose, including promotional use. You represent that you own or have all rights to the Feedback you submit and that it's accurate and lawful. We're not obligated to maintain Feedback in confidence, compensate you for it, or respond to it. We may, but are not required to, edit or remove Feedback we consider unlawful, offensive, or otherwise objectionable.
11. Errors and Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions in product descriptions, pricing, promotions, or availability. We reserve the right to correct any such errors and to change or cancel orders affected by them at any time, including after submission.

You agree not to use the Services to: (a) violate any law; (b) infringe our intellectual property or anyone else's; (c) harass, threaten, or defame any person; (d) transmit malicious code or interfere with the security of the Services; (e) scrape, harvest, or use automated tools, bots, or AI agents to access the Services without our prior written consent; or (f) circumvent any measures we use to restrict access to the Services. We reserve the right to suspend or terminate access at any time.
13. Termination
We may terminate your access to the Services at any time, at our discretion, without notice. You remain liable for any amounts owed up to the date of termination. Sections relating to intellectual property, feedback, disclaimers, limitations of liability, indemnification, and governing law survive termination.

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Some jurisdictions don't allow these disclaimers, so they may not fully apply to you.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BURSTA OTS, ITS OWNER, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES - INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS - ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
16. Indemnification
You agree to indemnify and hold harmless Bursta OTS, Shopify, and their respective affiliates and agents from any claims, damages, or liabilities, including reasonable attorneys' fees, arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your use of the Services.
17. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will stay in full effect.
18. Entire Agreement; Waiver
These Terms, together with our Privacy Policy and any other policies referenced here, are the entire agreement between you and Bursta OTS regarding the Services and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it.
19. Assignment
You may not assign these Terms without our prior written consent. We may assign them at any time without notice.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and Bursta OTS agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
21. Changes to These Terms
We may update these Terms at any time by posting the revised version here. Material changes will be communicated as required by applicable law and will take effect on the date specified. Your continued use of the Services after changes are posted constitutes acceptance.
